Wait ... the gun was pretty noticeable to many people in HLV, wasn't it? Yet isn't John still waving it around in T6T? Or was that a different one? Of course, he's not in England at the time ... but still, you'd think it would finally  have been confiscated ... did they just return it to John after Sherlock was captured and/or set free?

The pistol is one thing, but Sherlock also has that huge Magnum revolver, he shoots while quoting Shakespeare in TLD.
And didn't Sherlock asked John to get rid of the gun after shooting the Cabbie, or was it only in Pilot?

Only in the pilot (and John had already dumped it into the Thames).
